There are many ways to transfer property. Whether transferred during the course of selling your property or simply as a means to grant ownership, perhaps one of the easiest means is through a Quitclaim deed. Quitclaim deeds have been around for many years and while generally the same from state to state, you should be aware of differences. In Iowa, for example, before you can file a quitclaim deed, property owners must submit a declaration of value form. This form lists when property was purchased, the original cost, current appraised value including any improvements you have made. When a quitclaim deed is filed in Iowa the law does not guarantee a clean title. This is an important aspect and it is recommended that owners who receive title through the quitclaim process should research the property themselves prior to becoming owners. You may find out your new property has tax or mechanics liens. You will be responsible for these liens if a search at the Registry of Deeds discloses outstanding debts tied to the property. Another Iowa provision on property transfers is a groundwater hazard form. Any person transferring interest in real estate must complete this form. The form contains questions about the possibility of contaminants on the property that could affect the water table. If there is a septic system for human waste removal on the property the deed may not be recorded until a proper environmental study is completed. Private burial plots that are on the transferred property also fall into this category. Without the groundwater hazard form and a completed environmental study of the water table, the deed cannot be recorded. Quitclaim deeds convey the grantor's rights or interest but do not guarantee ownership. These deeds are not the same as warranty deeds. Warranty deeds come with multiple guarantees such as the right to convey the property and protection against any defects of the title. Always consult your attorney if you have questions or concerns.
